By downloading, installing, or using Ode ("the App"), you agree to these Terms of Use, an agreement between you and Ode Wellbeing Ltd ("we," "us," "the Developer") only — not with Apple Inc. The Developer, not Apple, is solely responsible for the App and its content. Apple has no obligation to furnish any maintenance or support with respect to the App.
Ode is an educational and organizational tool that helps a user track a partner's menstrual cycle and log related observations. Ode provides general, educational information and is not, and does not claim to be, medical advice, a diagnostic tool, or a substitute for consultation with a qualified healthcare professional.
You must be at least 17 years old to use Ode, given the sensitive nature of the health-related information the App deals with.
Ode is designed to be used with the knowledge and ongoing consent of the person whose cycle you are tracking. By using Ode to track another individual, you represent and warrant that you have informed that person and obtained their ongoing consent, and that you will stop tracking and delete their data if consent is withdrawn. You agree to indemnify and hold harmless the Developer from any claim arising from your failure to obtain or maintain that consent.
Ode stores all data locally on your device, encrypted, with no transmission to any server. Because Ode has no backend, the Developer has no ability to access, recover, or restore your data if lost. You are responsible for any backup you wish to maintain outside the App.
Premium features require a paid, auto-renewing subscription, billed through your Apple ID. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your device Settings. Refunds are handled by Apple.
Subject to these Terms and Apple's Usage Rules, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use.
You agree not to use the App to surveil, harass, isolate, or control another person against their knowledge or will.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you, if any was paid to Apple. Apple has no other warranty obligation whatsoever. The App is otherwise provided "as is," without warranties of any kind. The Developer does not warrant that the App's predictions or guidance will be accurate, and such information should never be relied upon for medical, contraceptive, or fertility-related decisions.
The Developer, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal or regulatory conformance, and consumer protection or privacy legislation, as well as any third-party intellectual property infringement claim.
To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App.
You may stop using the App at any time by deleting it. The Developer may suspend or discontinue the App or any feature at any time.
These Terms are governed by the laws of England and Wales.
